Fifty construction companies have been barred from taking part in public procurement processes with the State due to serious contractual breaches, revealed Gilberto Fitela, Head of the Department of Studies and Institutional Relations of the National Public Procurement Service (SNCP), this Wednesday in Luanda.
The SNCP disclosed the figures following a survey conducted a year ago on companies in breach of their obligations with the State.
Speaking to the press during the launch ceremony of the book “The Termination Procedure in Public Works Contracts”, authored by the SNCP, Fitela added that the list includes both Angolan and foreign companies.
According to the official, companies in this situation are prohibited from bidding for a period ranging from one to three years, with the possibility of reversal only if the State is fully compensated.
“A significant portion of contract terminations in public works are triggered by contractor default — that is, failure to meet deadlines, quality standards, or project obligations,” he explained.
Without disclosing the financial losses resulting from terminated contracts between the State and defaulting companies, Fitela acknowledged only that the amount was considerable.
Regarding the book “The Termination Procedure in Public Works Contracts”, which he coordinated, Fitela explained that the lack of knowledge on both sides about the procedures involved in contract terminations motivated its publication.
“There is a considerable degree of difficulty, both on the part of contracting public entities and economic operators, in understanding the procedures to be followed in cases where public works contracts need to be terminated,” he stressed.
The book, aimed at economic operators and public contracting entities, provides technical guidance on the relationship between both parties, as well as the procedures to be observed in the context of contract termination.
Published by the SNCP, the book has 72 pages, with 3,000 copies printed, being sold at 10,000 kwanzas each.
